Under the California Safer Consumer Product Regulations, maker of products that are selected as “priority products” will be invited to participate in a grueling paperwork-laden regulatory process, that involves multiple notifications, alternatives analyses, chemical hazard and environmental assessments for the entire lifecycle of making their product from raw material extraction, manufacturing, transportation, use by consumer and ultimate disposal of product. In August 2014, the California Department of Toxic Substance Control (“DTSC”) held two workshops about the draft Priority Products Work Plan, which were discussed in a prior post.

On September 12, 2014, California released the product categories that will be the focus of their regulatory interests and efforts in the next three years in its first three year work plan. They are:

  1. Beauty, Personal Care and Hygiene Products
    o Body wash and soaps
    o Deodorants
    o Lip balms and gloss
    o Lotions
    o Ointments
    o Pomades
    o Hair care products
    o Cosmetics
    o Nail care productsThe chemicals used in these products which are of regulatory interest are:Aldehydes, formaldehyde
    Cross-linking agent, modifier, preservative
    Alkyl phenols & ethoxylates
    Azo dyes, coal tars, lead, and lead acetate
    Colorant, dyes, pigment
    Emulsifier, plasticizer
  2. Building Products
    o Paints, primers and cleaners
    o Adhesives and glues
    o Sealants
    o Flooring and carpeting
    o Roof coatings
    o Stains and varnishesThe chemicals used in these products which are of regulatory interest are:Brominated or chlorinated organic compounds, organophosphates
    Flame retardant
    Reactant, precursor
    Metals, such as Chromium VI
    Dyes & Pigment
    Perfluorinated Compounds
    Repellent (water-, oil-, stain-)
    Volatile Organic Compounds, such as formaldehyde, n- hexane, n-methyl-pyrrolidone, toluene
  3. Home and Office Furnishings
    o Bedding
    o Fabric and textiles
    o Seating and sofasThe chemicals of interest in these products are flame retardants or stain resistant chemicals, specifically chlorinated and brominated organic compounds, organophosphates and perfluourinated compounds.
  4. Cleaning Products
    o Air fresheners
    o Floor cleaners
    o Oven cleaners
    o Bathroom cleaners
    o Carpet cleaners
    o Detergents
    o Floor waxes
    o Spot removers
    o Scouring cleaners
    o Window cleanersThe chemicals of interest in these products are:Alkyl phenol and ethoxylates
    Hydrogen Fluoride
    Anti-scaling agent
    Volatile Organic Compounds, such as n-hexane, methyl ethyl ketone, n-methyl-pyrrolidone, toluene, and xylene
  5. Clothing
    o Full body wear
    o Lower body wear
    o Sleepwear
    o Sportswear
    o Upper body wearThe chemicals of interest in these products are:Alkyl phenol & ethoxylates
    Aromatic amines and azo dyes
    Colorant, Dye, Pigment
    Chlorinated paraffins, halogenated compounds, and organophosphates
    Flame retardant
    Perfluorinated Compounds, formaldehyde
    Repellent (water-, oil-, stain-, wrinkle-)
    Antimicrobial agent, Material Preservative
  6. Fishing and Angling EquipmentThe products of regulatory interest are fishing weights and gears that may contain lead, zinc or copper.
  7. Office Machinery with refillable componentso Printer inks
    o Specialty paper
    o Toner cartridgesThe chemical of regulatory interest in these products are:Azo dyes
    Stabilizer, plasticizer
    Volatile Organic Compounds, such as benzaldehyde, hexanol, toluene, and xylene Solvents
